AG Hesitant on Ferguson Appeal

In a brief filed Friday, Missouri Attorney General Chris Koster said he did not want to hear the appeal of a convicted Columbia killer. Ryan Ferguson filed an appeal last month after Cole County judge Dan Green denied him a new trial in the spring, citing a lack of new evidence. AG Koster agreed, writing that continuing with another appeal would be a "waste of judicial resources." The brief cited a recent interview Ferguson did for the CBS program "48 Hours," and claimed that his defense had no new evidence or arguments. Ferguson's attorneys and family said they would continue to fight for another appeal. Ferguson was convicted of the 2001 Halloween night murder of then-Columbia Daily Tribune sports editor Kent Heitholt. He has denied his involvement with the beating death since his arrest several years later.
